Terms of Service

The rules for using BuzzyPod — accounts, teams, subscriptions, analytics, and guest release agreements. By using BuzzyPod, you agree to them.

1. Agreement to these terms

These Terms of Service are an agreement between you and BuzzyPod LLC, a South Carolina limited liability company (“BuzzyPod,” “we,” or “us”), and govern your use of BuzzyPod, the podcast analytics and operations platform available at buzzypod.com and app.buzzypod.com. By creating an account or using the platform, you agree to these Terms. If you use BuzzyPod on behalf of a company or team, you represent that you have authority to bind that organization.

2. Your account

You register with an email address and password. You agree to provide accurate information, keep your credentials confidential, and accept responsibility for all activity that happens under your account. Notify us immediately if you suspect unauthorized access.

3. Teams

BuzzyPod is organized around teams. Team admins can invite and remove members, assign roles, and manage the team’s subscription. Content and analytics in a team workspace are visible to its members, so only invite people you trust with that data.

4. Your podcast and analytics data

You may only connect podcast feeds that you own or are authorized to manage. Listener analytics are sourced from third-party services (OP3 and Podcast Index) and presented as aggregate estimates; they may differ from figures reported by other platforms, and their availability depends on those services. Analytics are provided for informational purposes and without guarantees of completeness or accuracy.

5. Guest release agreements

BuzzyPod includes a tool for creating and electronically signing guest release agreements, including appearance releases and exclusive rights licenses, between you and your guests. BuzzyPod is not a party to those agreements, is not a law firm, and does not provide legal advice — you are responsible for confirming that an agreement is suitable and enforceable in your jurisdiction. To support the validity of electronic signatures, we record an audit trail for each signing event (including IP address, browser details, and timestamps). You may only send signing invitations to guests who have agreed to appear on your podcast, and you must not misrepresent your identity or the agreement’s contents.

6. Subscriptions and billing

BuzzyPod offers a paid subscription with a 14-day free trial; when the trial ends, paid features require an active subscription. Payments are processed by Stripe, which collects your payment details, billing address, and applicable taxes at checkout. Subscriptions renew automatically until canceled. You can cancel at any time through the billing portal, and cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law. If prices change, we will give you advance notice before the change applies to you.

7. Acceptable use

You agree not to misuse the platform. This includes attempting to access other teams’ data, probing or disrupting the service, reverse-engineering the system, connecting feeds you have no rights to, using the release agreement tool to deceive signers or send unsolicited signing requests, or using the service for unlawful activity.

8. Intellectual property

The BuzzyPod platform, including its software, design, and branding, belongs to us and is protected by intellectual property laws. Your podcast content, your data, and the agreements you create remain yours. You grant us a limited license to process your data solely to provide and improve the service.

9. Service availability

We aim to provide a reliable service but do not guarantee uninterrupted access. Features may be added, changed, or discontinued, and analytics depend on third-party data sources outside our control.

10. Termination

We may suspend or terminate accounts that violate these Terms. You may stop using BuzzyPod and cancel your subscription at any time. Signed release agreements remain valid records for their signers after termination.

11. Disclaimers

BuzzyPod is provided “as is” and “as available,” without warranties of any kind. We do not warrant the accuracy of analytics data, and nothing in the platform — including generated release agreements — constitutes legal advice.

12. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the platform, and our total liability is limited to the amounts you paid us in the twelve months before the claim arose.

13. Governing law

These Terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-law rules. Any dispute arising from these Terms or your use of the platform will be resolved in the state or federal courts located in South Carolina, and you consent to their jurisdiction. This does not affect the governing law your guests and you select within individual release agreements.

14. Changes to these terms

We may update these Terms from time to time. We will post changes on this page, and continued use of the platform after changes take effect constitutes acceptance.
